Qualifications and requirements

1. Delivery / pick up

1.1. The rental car shall be delivered in good condition, with a full tank of fuel, with all the car papers and keys and, unless otherwise provided in the Rental Agreement, without any distinguishable exterior damage. On delivery Renter/Driver must check:

1. that the rental car is delivered without any damage visible on inspection, and
2. that any distinguishable damage is entered in the place provided in the Rental Agreement
3. fuel level

1.2. Upon inspection of the vehicle, Renter/Driver and KOMPAS RAC representative will confirm acceptance of the vehicle condition by signing the "Vehicle Condition Form".

2. Authorized driver

The rental car may only be driven by authorized drivers. Authorized drivers shall be the signatory to the Rental Agreement and those persons listed in the Rental Agreement as authorized drivers. Authorized drivers are not allowed to drive the rental vehicle when under influence of alcohol, medicaments or drugs, or in any other conditions which might adversely affect their reactions ( e.g. over tiredness and illness).

3. Voucher value, rental period and possible additional costs

3.1. Voucher value: applies to days (1 Day = 24 hrs) as indicated on the voucher starting from the time of delivery. In the event that time being exceeded by 60 minutes or more 1/3 day charge shall be made, by 120 minutes 2/3 day charge and over 180 minutes an additional day shall be charged to Renter/Drivers CC.

3.2. The daily rental price: applies to 24 hours from delivery of the car. In the event that rent is exceeded by more than 60 minutes 1/3 day charge shall be made, by 120 minutes 2/3 days charge and over 180 minutes additional day shall be charged to Renter/Drivers CC.

3.3. Fuel costs: KOMPAS RAC rental price shall include the cost of oil and servicing but not fuel costs. In event of returning the car with less fuel than at the beginning of rental period Renter/Drivers will be charged the difference according to the KOMPAS RAC price list (3 EURO + VAT per liter). Fuel level shall be checked by KOMPAS RAC representative, Renter/Driver and confirmed by both parties signature on the "Vehicle Condition Form".

3.4. Airport Fee: An additional fee of 20 EURO + VAT shall be charged on all rentals starting at KOMPAS RAC airport offices.

3.5. Reservations: can only be confirmed for the vehicle category of car, and not for a specific make.

3.6. Mileage charges: shall be made by KOMPAS RAC, insofar as this is indicated in the Rental agreement. Renter/Driver will be informed about this option at the beginning of rental period.

3.7. After hours charges of 12.20 € (VAT included): shall apply to all reservations/agreements starting after official working hours of the specific station.

3.8. By signing the rental agreement, Renter/Driver accepts that KOMPAS RAC is not liable for any consequences caused by not delivering the vehicle in case of any defect on the vehicle during the rental.

3.9. By signing the rental agreement Renter/Driver is obligated to pay all traffic violation tickets, parking fees accrued during the rental period and accepts that KOMPAS RAC charges all such costs through Renter/Drivers deposited Credit Card at a date of receiving such claims.

4. Compulsory insurance

All cars rented from KOMPAS RAC include Third Party Liability Insurance. Third Party Liability Insurance is a legal requirement and it protects the Renter/Driver, and other authorized drivers against liability that might arise by causing death or injury to other people. Third Party Liability Insurance does not cover loss of, or damage to the rental vehicle – Renter/Driver is responsible for the full value of the vehicle regardless of fault. (Subject to acceptance of the optional insurance options).

5. Optional insurance

5.1. When renting from KOMPAS RAC Renter/Driver is responsible for returning the vehicle in the same condition as at the beginning of rental, excluding normal wear, tear and normal cleanliness. If the vehicle is stolen, lost or damaged, regardless of fault, Renter/Driver will be absolutely liable for costs and losses incurred to KOMPAS RAC. This includes towing, recovery, repairs, storage. If renter/driver chooses CDW or/and TP limitation of liability (in such case "YES" will be entered in the relevant place in the Rental Agreement), liability shall be limited to an Excess/Deductible Amount according to the price list of KOMPAS RAC and will be stated on the Rental Agreement (depending on car model).

5.2. CDW (Collision Damage Waiver) limitation of liability: This limitation of liability shall apply to damage to the rental vehicle, its parts and accessories caused in a road/traffic accident. CDW limits Renter/Driver financial responsibility to the Excess Amount stated on the Rental Agreement. CDW does not cover any damage to the interior of the rental vehicle, tire and wheel damage, damage to the underside of the vehicle, broken or lost keys or contamination of fuel, neither in event of deliberate intention or negligence. Any damages to these vehicle parts will be charged to Renters/Drivers CC, regardless of fault, in full cost per official dealership price list at check in time.

Upon return of vehicle, condition shall be checked by KOMPAS RAC representative together with Renter/Driver and compared with the condition at rental start as stated on the "Vehicle Condition Form". All possible changes shall be entered into the form and confirmed by both parties signatures. When failing to sign the "Vehicle Condition Form" and filling out the "Damage report" Renter/Driver accepts official dealership estimates on disputed damages.

5.3. TP (Theft protection/Waiver) limitation of liability: This limitation shall apply in the case of loss of the rental vehicle, its parts and accessories (including tires, stereo equipment etc.) as a result of theft or attempted theft. TP limits Renter/Drivers financial responsibility to the Excess Amount stated on the Rental Agreement. TP is not valid if the vehicle is left unlocked or the keys are left unattended with the vehicle.

5.4. SCDW (Super Collision Damage Waiver): By accepting SCDW Renter/Driver financial responsibility for accidental damage to the vehicle, its parts and accessories, theft or attempted theft is reduced to zero. SCDW does not cover any damage to the interior of the rental vehicle, tire and wheel damage, damage to the underside of the vehicle, broken or lost keys or contamination of fuel, neither in event of deliberate intention or negligence. Any damages to these vehicle parts will be charged to renters/drivers CC, regardless of fault, in full cost per official dealership price list at check in time. Police report is mandatory for each damage.

5.5. Baggage insurance does not exist. Any liability on the part of KOMPAS RAC for loss or damage to items placed or left in the rental vehicle shall be excluded to the extent permitted by law.

6. Conduct after accident, damage, loss and theft

In case of such event Renter/Diver must do the following:

1. Immediately inform the Police and KOMPAS RAC and follow their instructions and take down all the details of any other parties involved.
2. Complete an accident/damage report upon return of vehicle.
3. Upon the return of rental vehicle write down a brief statement explaining the course of events.

The English version of the agreement is only a translation of the official Croatian text. In case of disputes, only the Croatian text shall be used in interpreting the agreement. All disputes arising in connection with the agreement shall be settled by the authorized court in Dubrovnik.
